1. Acceptance of terms

These Terms & Conditions (“Terms”) form an agreement between you and Transform Inc (“we”, “us”) for the SlideshowVideoMaker app and this website (together, the “Service”). If you do not agree, do not use the Service. If you use the App on behalf of a business, you confirm you are authorized to accept these Terms for it.

2. Apple App Store terms

You acknowledge that these Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the App, and is not responsible for claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the App must also comply with Apple’s Media Services Terms and the Apple Usage Rules.

3. Licence

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download and use the App on Apple devices you own or control, for lawful personal or business purposes. You may not copy, modify, reverse engineer, decompile, sublicense, rent, sell or create derivative works of the App, except where the law allows.

4. Your content

You keep all rights in the photos, videos, audio and text you use in the App (“Your Content”). You are solely responsible for Your Content and confirm you own it or have all rights and permissions needed to use it, including rights in music, images of people, and trademarks. Because Your Content is processed on your device, we do not claim any licence to it.

5. Acceptable use

You agree not to use the Service to create or share content that is unlawful, infringing, defamatory, harassing, hateful, sexually exploitative, deceptive, or that violates others’ privacy or intellectual property. You will not attempt to disrupt, scrape, attack or gain unauthorized access to the Service.

6. Music, stickers and bundled content

Music, stickers, fonts, transitions and other content bundled with the App are licensed to you for use inside videos you create with the App. You may not extract and redistribute them on their own. Songs imported from your device remain subject to the rights of their owners. Make sure you have permission before publishing a video that contains third-party music on social platforms.

7. Subscriptions and purchases

• Some features may require a paid subscription or in-app purchase. Prices and options are shown in the App before you buy.
• Payment is charged to your Apple ID at confirmation of purchase.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• Manage or cancel in iOS Settings → your name → Subscriptions. Deleting the App does not cancel a subscription.
• Any unused portion of a free trial is forfeited when you purchase a subscription. Refunds are handled by Apple under its policies.

8. Advertising

The free version may display advertisements. We are not responsible for the content of third-party ads or the sites they link to.

9. Intellectual property

The App, its design, code, trademarks, logos and bundled content (other than Your Content) are owned by us or our licensors and protected by intellectual property laws. No rights are granted except as stated in these Terms.

10. Third-party services

The App may link to or use third-party services (for example the App Store, analytics, advertising and subscription providers). Their terms and privacy policies apply to your use of them.

11. Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that exported videos will be free of defects on every device. Keep backups of important media.

12. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us for the App in the 12 months before the claim, or USD 50 if you paid nothing. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnity

You agree to defend and hold us harmless against claims, damages and expenses (including reasonable legal fees) arising from Your Content or your breach of these Terms or applicable law.

14. Termination

You may stop using the Service at any time by deleting the App. We may suspend or end your access if you breach these Terms. Sections that by nature should survive termination will survive.

15. Changes

We may update the App and these Terms. We will update the “Last updated” date and, for material changes, may notify you in the App. Continued use means acceptance.

16. Governing law

These Terms are governed by the laws of the jurisdiction where Transform Inc is established, without regard to conflict-of-law rules, and subject to any mandatory consumer rights in your country of residence.
